It is a very emotional and difficult time when a family member is no longer able to make decisions for himself or herself.  A power of attorney is a document in which a person gives another person the authority to make financial and/or healthcare decisions on his or her behalf and no court action is required.  The person giving the power of attorney must be competent at the time of the creation of the document.  Financial powers of attorney are also useful documents when a person is out of state and needs to have financial transactions conducted in his or her absence.
